Preamble

In this license, ‘Given Typeface’ refers to the given font (Hubert) or zip file, which may contain one or numerous fonts. The included fonts can be of any type (.ttf, .otf, .woff2, etc.) and together may form a ‘font family’ or in short a ‘typeface’.

‘Respective owner’ refers to Phil Strahl (Pixel Prophecy), the original creator of the typeface.

‘Licensee’ means the individual or legal entity that uses the typeface and/or distributes or commercially exploits a product in which the typeface is used.

1. Copyright

The Given Typeface is the intellectual property of the Respective owner and is protected by copyright law.

2. Personal Use

The fonts of the Given Typeface may be downloaded and used for personal and limited commercial use (see 3. Commercial Use, below), as long as the usage is not racist, sexist, illegal, defamatory, or otherwise violating human dignity. This includes but is not limited to:

  • use in your personal documents, logos, presentations, etc.
  • prints with low circulation such as invitations, T-shirts, flyers, etc.
  • use in non-profit organizations

3. Limited Commercial License

This license grants a non-exclusive right to use the typeface in commercial projects, provided the Licensee’s total gross annual revenue does not exceed 50,000 EUR. If this threshold is exceeded, a separate Full Commercial License must be obtained.

3b. Commercial Use in Digital and Physical Media

Phil Strahl (Pixel Prophecy) allows use of the typeface in digital works, media, and entertainment products (such as but not limited to) video- and computer games, apps, websites, as well as motion graphics, images and designs, branding and corporate designs, e-books, printed magazines, post cards, mugs, T-shirts, etc. provided:

  • the font file(s) are embedded in software with reasonable technical measures to prevent extraction and reuse as a standalone font
  • the annual total gross revenue of the Licensee (the individual or entity) does not exceed 50,000 EUR
  • Phil Strahl (Pixel Prophecy) receives credit with the typeface in the game (see 4. Crediting the Respective owner)

If these conditions cannot be met, please contact Phil Strahl (Pixel Prophecy) to ask for commercial licensing.

4. Crediting the Respective owner

The Respective owner of the typeface must be given credit in a place where references and other credits are listed for the respective medium and use; e.g. in a video’s and game’s Credits section; a website’s imprint, or a book’s copyright/verso page and must include the name of the typeface and the creator, e.g.

Typeface “Hubert” by Phil Strahl (Pixel Prophecy)

In some cases, giving proper credit is impractical and may be omitted (e.g. for logo designs, mugs, etc.)

5. Modification

Except for the format conversions permitted in Section 6, the Given Typeface may not be modified, altered, adapted, reverse-engineered, or built upon, either in part or as a whole without written permission by Phil Strahl (Pixel Prophecy). This pertains to all files within the downloadable font and/or zip-file.

6. Conversion

The Given Typeface may be converted to other formats such as WOFF, SVG, or webfonts, as long as

  • this does not contradict the terms stated in 3. Commercial Use
  • the typeface is not modified in any other way, such as changing name(s), altering glyphs, modifying metadata, etc. except for technical optimizations that do not alter the design of the glyphs

7. Distribution

The typeface may be shared in its original form with individuals for personal, non-commercial use only. It may not be uploaded to public platforms, repositories, or otherwise made publicly availible without permission.

8. Disclaimer

The Given Typeface is offered ‘as is’ without any warranty. This license is non-transferable and may not be sublicensed. Phil Strahl (Pixel Prophecy), the respective author of the Given Typeface shall not be liable for any damage derived from using this typeface. By using the Given Typeface the Licensee agrees to the terms of this license. This license is governed by the laws of Salzburg / Austria.

9. Termination

Any breach of the terms of this license will result in the immediate and automatic termination of the license. Upon termination, the Licensee must cease all use of the Given Typeface and delete all copies in their possession. This does not require withdrawal of already distributed products, but no further distribution may occur.
